CardioSmart Points Program Rules
Overview of CardioSmart Points Program
The CardioSmart Points Program (“Program”) is sponsored by the American College of Cardiology Foundation (“ACC”). The Program allows users to accumulate points based on their level of participation on the CardioSmart.org website as more fully described below. For purposes of these Program Rules, users of the CardioSmart Points Program shall be referred to as Individual and collectively as individuals (“Individual(s)”).
Who can participate in CardioSmart Points?
The Program is open to all users of CardioSmart.org who are eighteen (18) years of age or older. Employees of the American College of Cardiology and the American College of Cardiology Foundation are not eligible to participate in the Program. The Program is void where prohibited by law.
Enrollment in Program
Individuals meeting the eligibility requirements described above are eligible to participate in the Program once they have registered for CardioSmart at the following link: https://www.cardiosmart.org/Login.
Points will be collected based on unique Individual’s use of CardiosSmart.org.
Collection of Points
Individuals may collect points by participating in certain activities available on CardioSmart.org as updated from time to time.
Individuals may redeem items in the CardioSmart store as listed in the store catalog. Items in the CardioSmart store are subject to availability. The store catalog will list the point value necessary to redeem each item. The items in the CardioSmart store will change from time to time. ACC reserves the right to modify the point value(s) for specific items at any time for any reason for the duration of the Program. All redemptions are subject to these Program Rules and the Terms and Conditions of the Cardiosmart.org website.
To redeem items navigate to the item you wish to redeem in the CardioSmart store. Individuals may redeem any items available in the store that are available in inventory and that the Individual has accumulated the minimum point value necessary to redeem the item. Once an item is chosen the Individual must click on the “Redeem” button. To confirm the redemption of the item, the Individual must then click on the “Submit” button.
Individuals are responsible for maintaining up-to-date user profile on CardioSmart.org. Specifically, Individuals are responsible for ensuring that their mailing address and email address are up to data at all times. ACC is not responsible for non-receipt of any item redeemed in the CardioSmart store that was shipped to the mailing address reflected in the Individual’s account. ACC is not responsible for any incorrect or inaccurate information supplied in a user’s profile.
The term of the Program is from Feb. 6, 2013 to Feb. 6, 2016. All point redemptions are final. Refunds or exchanges are prohibited. Individuals may redeem points up until the end of the Program. ACC reserves the right to change the termination date of the Program.
Modification, Conduct and Termination of the Program
ACC reserves the right to modify any of the Program Rules set forth herein, including, but not limited to, the duration of the Program, the ways by which Individuals may collect points, the inventory in the CardioSmart store, the number of points associated with the redemption of inventory in the CardioSmart store, the number of points that may be redeemed through the Program, and any other benefit made available to Individuals at any time, with notice, even though these changes may affect a Individuals ’s ability to accrue or use his/her points. If, for any reason this Program is not capable of running as planned, or if infection by a computer virus, bug, tampering, hacking, unauthorized intervention, fraud, technical failures or any other causes corrupt or affect the administration, security, fairness, integrity or proper management of the Program, ACC reserves the right at its sole discretion to disqualify any Individual or to modify, terminate, cancel or suspend, in whole or in part, the Program. ACC reserves the right to terminate or temporarily suspend the Program at any time, for any reason, with notice, even though termination may affect an Individual’s ability to accrue or use his/her points. If the Program expires as scheduled, Individuals will have until the end of the Program period to redeem their points. An Individual’s continued participation in the Program constitutes the Individual’s acceptance of any modification to these Program Rules. Individuals are responsible for remaining knowledgeable of any modifications to the Program Rules. The current version of the Program Rules will be available on CardioSmart.org, and will supersede all previous versions of these Program Rules.
Terms and Conditions
ACC does not charge for registering on the CardioSmart site. Any Individuals who pay for Internet access will be responsible for paying for connect time at their appropriate rates. No purchase or compensation is necessary to participate in the Program. The CardioSmart Points have no cash value and are only redeemable for inventory available in the CardioSmart Store via the Program.
Individuals that do not comply with the Program Rules shall be subject to disqualification without notice. Individual agrees to release and hold ACC and the employees, officers, directors, successors, agents and representatives, licensees, advertising, promotion, judging or fulfillment agencies, harmless from any and all injuries, losses, damages, rights, claims, and actions of any kind arising in connection with participation in the Program resulting from the acceptance, possession, or use of any item redeemed through the Program including without limitation, personal injury, death, and property damage, and claims based upon publicity rights, defamation, privacy rights or invasion of privacy.
ACC reserves the right to rescind points credited to an Individual’s account which were obtained as a result of fraudulent or unfair activity or technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software related to the Program.
Points are not the property of an Individual and may be revoked at any time by ACC as set forth herein. Points may not be transferred or assigned. All questions or disputes regarding eligibility for the Program, collecting or redemption of points, or an Individuals’ compliance with these Program Rules will be resolved by the ACC in its sole discretion.
INDIVIDUALS EXPRESSLY UNDERSTAND AND AGREE THAT ACC SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA LOSS, OR OTHER LOSSES (EVEN IF ACC HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES) RESULTING FROM INDIVIDUALS PARTICIPATION IN THE PROGRAM.
If any provision of these Program Rules is found to be unenforceable in any respect by a court of competent jurisdiction, Individual understands that these Program Rules shall nonetheless be enforced to the maximum extent to which it is found to be legally enforceable. TO THE EXTENT PERMITTED BY LAW, INDIVIDUAL WAIVES THE BENEFIT OF ANY PROVISIONS OF ANY STATUTE OR OTHER LAW THAT MIGHT ADVERSELY AFFECT THE RIGHTS UNDER THIS AGREEMENT.
These Program Rules shall be governed by the laws of the District of Columbia, without reference to its choice of law rules to the contrary. Individual irrevocably consents to the exclusive jurisdiction and venue of the courts located in the District of Columbia, with respect to any claim or suit arising out of or in connection with these Program Rules, the Program, any delivery, mis-delivery or non-delivery of any item redeemed or Individual’s acceptance, participation in, use of, or inability to use any item redeemed, and Individual agrees not to commence or prosecute any such claim or suit other than in the aforementioned courts. INDIVIDUAL HEREBY IRREVOCABLY WAIVES ANY AND ALL RIGHT TO TRIAL BY JURY IN ANY LEGAL PROCEEDING ARISING OUT OF OR RELATING TO THIS AGREEMENT, PROGRAM OR ANY OF THE RELEASED CLAIMS.
Individuals who participate in the CardioSmart Points Program consent to the terms set forth above.
This Agreement is the entire agreement between ACC and Individual with respect to the matters described herein, and supersedes any and all other agreements and communications, oral or written, between Individual and ACC relating to the Program.
